The Supreme Court served an ultimatum to the NDA government on Tuesday, giving one day reveal the names of all Indians holding illegal bank accounts outside of a sealed envelope.
"The new regime can not come and tell us to change our orders. We will not clarify or modify our order 2011," the apex court said, adding, "the only role of government is to inquire about the black money accounts foreign banks. "
In 2011, the Supreme Court, which has been monitoring the investigations into the black money since 2009, had requested full disclosure of information about Indians holding black money abroad.
The order of the apex court came a day after the government named eight people being prosecuted for hiding money tax free in illegal bank accounts in Switzerland and other countries. Sources say that at least 800 Indians holding accounts in foreign nations such.
The Supreme Court diktat came a day after the Centre on Monday revealed eight names, including bullion trader consumer products giant Dabur India promoter Pradip Burman, based Pankaj Chamanlal Lodhiya Rajkot, Goa mining company Timblo Private Ltd. five of its directors - Radha Satish Timblo, Chetan S Timblo, Rohan S Timblo, Anna C and Mallika Timblo R Timblo.
Disclosure, the government said, was the first in what it claimed to be a series of such revelations in the coming days. Business leaders named in the affidavit subsequently issued separate statements, denying the allegations.
Affidavit Center also said that all accounts held by an Indian in a foreign bank may not be illegal and the fundamental right to privacy under Article 21 must be confirmed. Remembering the apex court treaty that prevented him from disclosing information, the affidavit said the government has to follow procedures.
The Centre said on Monday he was open to reveal the names of only "after following due process of law, in all cases where tax evasion is established."
Senior Supreme Court lawyer and main petitioner in the case of black money, Ram Jethmalani, slammed the Centre on the revelations, saying that the big fish involved in the case were not disclosed. "It's a case of the mountain in labor that produces a mouse," he said.
The opposition Congress later claimed that the eight names have been revealed by the previous UPA government. "These names were already revealed by the UPA. The selective leaking names of suspicious odors motivations," said Congress leader Sandeep Dikshit.
